New York civil rights violation lawyer David Perecman comments on the city's attempt to remove Judge Nicholas Garaufis from a race discrimination case against the New York Fire Department.
NEW YORK, NY, January 29, 2012 /United States PR News/ -- City officials are looking to remove U.S. District Court Judge Nicholas Garaufis from the race discrimination lawsuit over the New York Fire Department's hiring practices, reported the New York Daily News (1/20/2012).
In filed court papers, city attorneys argued that Garaufis ignored evidence, is being influenced by media, and is no longer showing neutrality, according to the New York Daily News.
"Reliable evidence is needed in the removal of a judge or the action may be perceived as a threat to the independence and integrity of the court system," said New York civil rights violation lawyer David Perecman.
The judge had ruled that the city "intentionally discriminated" against minority firefighter candidates and failed to ensure that enough minorities were being hired, reported the New York Daily News.
Garaufis then appointed an independent monitor to oversee the efforts to make the NYPD more diverse, said the Wall Street Journal (1/21/2012).
The New York race discrimination ruling against the FDNY came after the federal government and the Vulcan Society, a fraternal organization of black firefighters, sued the Fire Department of New York for race discrimination (Newsday 1/20/2012).
The current percentage of blacks in the FDNY is 3% while the black population in New York City is closer to 24% (NYDN).
